Is it legal for a civilian to wear an American flag patch?

Origin of the American Flag Patch

The origin of American Flag Patches can be tied to the origin of military patches as it was first found among the military. During the Civil War, a few soldiers wore these patches as done for them by their wives and friends. Then patches were handmade, therefore it was difficult to make them perfect or standardized. So after the United States Army joined the war in 1917, the 81st Infantry Division of the Army created the first shoulder sleeve insignia. Within two decades, every army division, group, squad or corps had their own shoulder sleeve insignia. 3.   The organization prescribing wearing the patch can decide where to wear it since the law does not address the positioning of the patch. However, you may also contact your state or city’s Attorney General’s office since different cities or states might have their own rules pertaining to the flag.

How an Army Personnel should wear the American Flag Patch

Headquarters, Department of the Army (HQDA) has a policy that authorizes all soldiers to wear the full color of the American flag patch with a size of 2 inches by 3 inches on the utility uniform. The patch is to be worn on the Army Combat Uniform (ACU) and its fire retardant variant, the Flame-Resistant Army Combat Uniform (FRACU). The policy states that the patch should be sewn about half inches below the right shoulder seam of these uniforms. If the shoulder sleeve insignia-former wartime service (SSI-FWTS) is worn on the right shoulder, the flag patch should be placed 1/8 inch below the SSI-FWTS.
